Common questions about property transfer duty in South Africa

Transfer duty is a tax levied on the acquisition of property in South Africa. It is payable by the buyer (purchaser) to SARS through the transferring attorney. Transfer duty applies to all immovable property transactions, including land, buildings, and any improvements on the property.
For the 2026/2027 tax year, transfer duty is 0% on properties up to R1,100,000. Above that threshold, progressive rates apply: 3% on R1,100,001 to R1,512,500, 6% on R1,512,501 to R2,117,500, 8% on R2,117,501 to R2,722,500, 11% on R2,722,501 to R12,100,000, and 13% on amounts above R12,100,000.
The buyer (purchaser) is responsible for paying transfer duty. The payment is handled by the transferring attorney (conveyancer) who collects the amount from the buyer and pays it to SARS as part of the property transfer process.
Transfer duty must be paid within six months of the date of acquisition (usually the date the offer to purchase is signed). The transferring attorney typically ensures this is paid as part of the registration process. Late payment may attract interest and penalties.
If the seller is a VAT vendor and the property is sold as part of the seller's enterprise, VAT at 15% is charged on the sale price instead of transfer duty. The buyer does not pay transfer duty in this case. This commonly applies to new developments sold by property developers.
There is no specific first-time buyer exemption for transfer duty in South Africa. However, all buyers benefit from the 0% transfer duty band on properties valued up to R1,100,000. This means properties under R1,100,000 attract no transfer duty regardless of whether you are a first-time buyer or not.
