Broad-Based Black Economic Empowerment (B-BBEE) applies to all businesses in South Africa, including sole proprietors. However, the requirements and benefits differ significantly depending on your annual turnover. Most sole proprietors qualify as Exempted Micro-Enterprises (EMEs) with turnover below R10 million, which greatly simplifies compliance.

As an EME, you are automatically rated as a Level 4 B-BBEE contributor. If you are a black-owned EME (more than 51% black ownership โ€” which for a sole proprietor means you are black), you are automatically Level 1. You do not need a formal BEE verification audit; a simple sworn affidavit confirming your turnover and ownership is sufficient.

While B-BBEE is technically voluntary, it is practically essential if you want to do business with government or large corporates. Procurement policies heavily favour businesses with good BEE scores, and many tender requirements include minimum BEE level thresholds.
